TERMS AND CONDITIONS

A participant’s entry into the Actimel promotion is subject to these terms and conditions and also unless otherwise stated in these terms and conditions to the Promoter’s privacy policy at http://www.actimel.co.uk/Privacy.aspx. All participants should read these terms and conditions and the privacy policy.

1. This promotion is open to residents of the UK only aged 18 and over, excluding employees and their immediate families of Danone Ltd, its associated companies, its agents and anyone professionally connected with the promotion.
2. All entry instructions form part of these terms and conditions. By entering this promotion, all participants will be deemed to have accepted and be bound by these terms and conditions.
3. To enter, access the online page at www.actimel.co.uk/live/spavoucher.aspx and answer the following question: In the popular story surrounding the origins of the Christmas stocking, how many pairs of stockings did St. Nicholas find drying on the mantelpiece? Internet access required. The online form must be completed and submitted in full.
4. The promotion opens on 16.12.11 and closes at midnight on 31.01.12. Entries outside of these dates will not be accepted.
5. Only one entry per person allowed. No bulk or third party entries. If it becomes apparent that a participant is using a computer(s) to circumvent this term by, for example, the use of 'script', 'brute force' or any other automated means, that person's entries will be disqualified and any prize award will be void.
6. There will be 2 winners. The winners will be the first two entries selected at random under independent supervision from all correct entries.
7. Each winner will receive a £250 Spa Voucher from http://www.spabreak.co.uk/. Vouchers are valid for 12 months and are redeemable in all venues featured on www.spabreak.co.uk. For full terms and conditions please see information on the website.
8. The winners will be notified by email, at the email address provided on the online form within 14 days of the closing date. All reasonable attempts will be made to contact the winners, but if this cannot be achieved within 28 days the Promoter reserves the right to withdraw entitlement and award the prize to a reserve chosen at the same time as the original.
9. The winners will be given instruction on how to claim their prize within their email. Claims must be made within 28 days of notification otherwise the prize will be lost.
10. No cash or other alternative to the prize is available. The prize will be delivered to the winner at the address provided on the entry form, via registered post.
11. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the stated prize, the Promoter reserves the right to award as substitute a prize of equal or higher value. The Promoter reserves the right to terminate, amend or extend this promotion in wholly exceptional circumstances outside its control.
12. Illegible, incomplete, incorrectly completed entries and defective entries will not be accepted. The Promoter cannot accept any responsibility for web access or other difficulties in entering, nor for any entries that are delayed lost or corrupted for any reason whatsoever. Proof of sending is not proof of safe receipt.
13. The winners names and counties will be available by sending in a stamped self addressed envelope to the promoter at ‘The Actimel Live December 2011 Promotion, Danone Ltd, 3rd Floor, International House, London, W5 5DW.’
14. The winners may be required to participate in publicity and where required to do so the winners consent to co-operate with the Promoter without further recompense.
15. To the fullest extent allowed by law, the Promoter does not accept responsibility for any loss or injury resulting from prize acceptance. This does not affect any statutory rights.
16. The Promoter's decision regarding any aspect of the promotion is final and binding and no correspondence will be entered into.
17. The Promoter takes its obligations under the Data Protection Act 1998 seriously. All information collected as part of this promotion is collected by the Promoter, or its agents, and will not be disclosed to any third parties, apart from for the purposes of administering this promotion. From time to time the Promoter may wish to send you information concerning its news, products, services and/or special promotions if you choose to opt-in to receive such communications. 18. Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction.
